Guys used to fistfight more than they do now. Bill James says that looking at anecdotes from baseball books from a century ago, ballplayers were more inclined to fisticuffs off the field back then than now.
So it might make sense for the courts to tighten up "fighting words" doctrines since it takes worse provocation, on average, to get people to fight nowadays.
